1. Our Legal Duty & Commitment to Privacy
THIS NOTICE DESCRIBES HOW MEDICAL AND RECOVERY INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Manageable Living LLC ("Manageable Living," "we," "our," or "us") is dedicated to protecting the confidentiality of your Protected Health Information (PHI) and personal records. PHI includes any demographic information, recovery background data, intake assessments, drug/alcohol test results, or medical accommodation notes that identify you and relate to your past, present, or future physical or mental health condition.
While Manageable Living operates as a residential sober living housing provider and does not provide clinical or medical treatment, we voluntarily adhere to the strict physical, technical, and administrative privacy standards established by the Health Insurance Portability and Accountability Act (HIPAA) to ensure our residents enjoy an atmosphere of total trust and safety. We are required by law to maintain the privacy of your PHI, provide you with this Notice of our legal duties and privacy practices, and abide by the terms of the Notice currently in effect.
2. How We May Use & Disclose Your PHI
Manageable Living may use and disclose your Protected Health Information for the following operational and recovery support purposes:
A. For Treatment Coordination & Recovery Support
We may disclose your housing status, attendance at mandatory 12-step recovery meetings, or urinalysis screening results to your designated clinical therapist, intensive outpatient program (IOP), psychiatrist, or case manager. We will only make these disclosures if you execute a formal, written Release of Information (ROI) authorization form.
B. For Payment & Billing Operations
We may use and disclose your personal details to process monthly residential rate payments, manage accounting ledgers, issue financial receipts, or provide necessary documentation if you are seeking reimbursement from an insurance provider or financial sponsor.
C. For Healthcare & Residential Operations
We may use your PHI for internal administrative operations necessary to run our sober living homes effectively. This includes assessing the quality of our recovery environment, conducting staff training, evaluating resident compatibility, and managing house safety protocols.
D. In Emergency Situations & As Required by Law
We may disclose relevant health information to first responders, paramedics, or hospital medical personnel in the event of an acute medical emergency, overdose, or severe mental health crisis occurring on or off the premises. We will also disclose PHI when required to do so by federal, state, or local law, such as pursuant to a valid court order or subpoena.
3. Uses & Disclosures Requiring Written Authorization
Other than the specific operational uses outlined in Section 2, Manageable Living will not use or disclose your PHI without your explicit written authorization. Specifically, the following disclosures require your prior written consent:
Disclosures to Family Members & Friends: We will not confirm your residency or discuss your recovery progress with family members, spouses, or friends unless you have listed them on an active Release of Information (ROI) form.
Disclosures to Employers or Legal Entities: We will not provide attendance verification or drug testing records to employers, probation officers, or legal counsel without your signed authorization.
Marketing & Sale of PHI: We will never sell, trade, or lease your PHI for commercial marketing purposes.
Right to Revoke Authorization: You may revoke any active written authorization at any time by providing written notice to our Privacy Officer. Upon receipt of your revocation, we will immediately cease any further disclosures, except to the extent that we have already acted in reliance on your prior consent.
4. Your Individual HIPAA Rights
You possess the following rights regarding the Protected Health Information we maintain in your resident file:
Right to Inspect & Copy: You have the right to inspect and obtain a copy of your resident file, intake assessments, and drug testing logs. Requests must be submitted in writing to our Privacy Officer.
Right to Request Restrictions: You have the right to request that we restrict how we use or disclose your PHI for treatment, payment, or operational purposes. While we will consider all requests, we are not legally required to agree to a restriction if it impedes house safety protocols.
Right to Request Confidential Communications: You have the right to request that we communicate with you regarding your residency or financial matters via alternative means or at alternative locations (e.g., contacting you only via a specific mobile number or email address).
Right to Request Amendment: If you believe that the health or intake information in your resident file is incorrect or incomplete, you have the right to request an amendment in writing, explaining the reason for the correction.
Right to an Accounting of Disclosures: You have the right to request a list of certain disclosures we have made of your PHI to external entities outside of standard operational or authorized disclosures.
Right to a Paper Copy: You have the right to obtain a physical paper copy of this Notice of Privacy Practices upon request at any time.
5. Breach Notification Protocols
Manageable Living maintains strict electronic and physical safeguards to secure your PHI. However, in the unlikely event that an unauthorized acquisition, access, use, or disclosure of unsecured PHI occurs (a "breach"), we are required by law to notify you in writing without unreasonable delay. The notification will explain the nature of the breach, the specific data involved, the investigative steps being taken, and the measures you can take to protect yourself.
6. Complaints & Reporting Violations
If you believe your privacy rights have been violated, or if you disagree with a decision we made regarding access to or amendment of your PHI, you have the right to file a formal complaint with Manageable Living or with the Secretary of the U.S. Department of Health and Human Services (HHS).
To file a complaint with Manageable Living, please contact our Privacy Officer in writing using the contact details provided in Section 7.
Zero Retaliation Guarantee: Manageable Living strictly prohibits any form of retaliation, harassment, or negative residential action against any resident or applicant who files a privacy complaint in good faith.
